End User License Agreement (EULA) for Vehicle Carbon Tracker SoftwareIMPORTANT - READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Eco Flow, a software company that provides vehicle carbon tracking software ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.License GrantSubject to the terms of this EULA, Eco Flow, grants you a non-exclusive, non-transferable, limited license to use the Software solely for your personal or internal business purposes. You may not rent, lease, lend, sell, redistribute, or sublicense the Software. You may not copy, modify, reverse engineer, decompile, disassemble, or create derivative works of the Software, except to the extent that applicable law expressly permits such activity. OwnershipThe Software is owned by Eco Flow, and its licensors and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Eco Flow, and its licensors retain all rights, title, and interest in the Software, including all intellectual property rights. of Warranties. The Software is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. [company name] does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In no event shall Eco Flow's total liability to you for all damages exceed the amount of fifty dollars ($50.00). Termination This EULA will terminate immediately if you breach any of its terms. Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software in your possession. Governing Law and Jurisdiction. This EULA will be governed by and construed in accordance with the laws of the jurisdiction in which Eco Flow, is located, without giving effect to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Florida, United states for any dispute arising out of or relating to this EULA. Entire Agreement. This EULA constitutes the entire agreement between you and Eco Flow, regarding the use of the Software and supersedes all prior agreements and understandings, whether written or oral, regarding such subject matter. If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. By clicking "I Agree" or by installing, copying, or otherwise using the Software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
